TFDP denounces police interference in human rights violation case

Task Force Detainees of the Philippines (TFDP) condemns the acts of Policemen SPO2 Argie Miraflores (detailed at Regional Intelligence & Detective Mgt. Division, Region XII) and SPO1 Israel Lantingan (detailed at Municipal Police station of Alabel, Sarangani Province) in their effort to impede the process of seeking for justice of torture victim Anuar Hasim.  The policemen facilitated Hasim’s signing of an Affidavit of Desistance without the assistance of his counsel and prior consultation with the victim and his family.

This act is again a clear violation of the victim’s constitutional right.  Hasim was illegally arrested on April 4, 2010 by a composite team of police and intelligence group along Champaca corner Lapu-Lapu Streets in General Santos City.  He was heavily tortured during interrogation.

Several times, he was slapped on the face, kicked on the chest, and punched on the abdomen.  His head was also wrapped with cellophane for several times.  The victim was strangled with a plastic wire and his left thumb was burnt with a cigarette.  He was also threatened to be buried alive.  This ordeal lasted for two days.

The victim was charged as Anwar Mustafa in the warrant of arrest for the crimes of murder, arson and robbery with violence and or intimidation of persons, which allegedly happened in Maasim, Sarangani Province in 2008.

Prior to the signing of the affidavit, two policemen, one of whom was a certain Jamael Amykulot, connected to the Regional Office XII, visited the victim and conducted an interview.  They were the ones who drafted an Affidavit-Complaint for Hasim without proper consultation with his family or his lawyer.

Although the signing of the Affidavit of Desistance was considered null and void, TFDP questions the motives behind the policemen’s actions. As investigators, they should ensure that due process is observed at all times.  What they did, however, may jeopardize the filing of complaint against the perpetrators of torture.

TFDP urges Deputy Director General Jesus A. Verzosa, Chief of the Philippine National Police, to conduct an impartial investigation to look into these police officers’ actions.  They may be liable of being accomplice to the crime of torture.  Appropriate sanctions must be afforded to them.
