Tulid, who was a victim of extrajudicial killing due to her human rights work as a human rights defender and a member of Samahan ng Magsasakasa Barangay Tala at Camflora (Organization of farmers in Barangay Tala and Camflora), in San Andres, Quezon.

Description of the case:

Elisa LascoñaTulid, a human rights defender and agrarian reform beneficiary, was a leader of the farmers’ group, Samahan ng Magsasaka sa Barangay Tala at Camflora, was killed on October 19, 2013 at around 2:00PM, at Sitio Kumbenyo, Barangay Tala, San Andres, Quezon.

Based on documentation by the Task Force Detainees of the Philippines (TFDP), Ms. Tulid was walking along with her husband and her four-year-old daughter when she was shot point-blank by a man who was identified as Mr. Rannie Bugnot, suspected trustee of Mr. Edwin Ausa, an alleged land grabber in the area.Ms. Tulid who suffered gunshot wounds in the nape, mouth, left eye and left thigh, was pronounced dead on the spot. Her husband and daughter both managed to run away. Her husband rushed to a nearby military camp in Barangay Tala to seek help and report the incident. The military called the police and requested their assistance. The police arrested Mr. Bugnot on the same day at his house in San Andres, Quezon and charged him later for murder.

As of this writing, suspect Mr. Bugnot is in detention at Bureau of Jail Management and Penology (BJMP) Gumaca District Jail, Quezon. The case is pending before the Regional Trial Court (RTC) Branch 62 in Gumaca, Quezon.

Background information

There is a persistent agrarian conflict in Bondoc Peninsula where San Andres, Quezon is located, where almost 80 percent of households depend on subsistence farming mainly banana and coconut mono cropping as well as fishing.

A Restrained Celebration for Mother Earth


atm-logoOn April 22, 2015, the world celebrates the 45th anniversary of Mother Earth. Alyansa Tigil Mina, a coalition of more than a hundred organizations joins this celebration of 2015 Earth Day. As an environmental and human rights organization, today is celebrated as we renew our vows of upholding environmental and climate justice. With this vow, we stand firm and vigilant to pursue justice. Sadly however, the glaring truth is that this celebration is not one of victory, but a swelling of renewed commitment drawn from defeats.

This is not a time for the country to hold its head high as the world celebrates mother Earth. This is a time for vigilance; a time to collect dues from those who are accountable for the continuous destruction of our environment as 2015 did not start off promisingly for environmental advocates especially to those upholding advocacies on anti-mining.

Assaults against Mother Earth were felt by anti-mining communities.  The continuing illegal activities for the Free and Prior Informed Consent (FPIC) of Blaans in Tampakan, South Cotabato; the lifting of suspension orders against mining companies in Zambales; MMDC’s disregard of the Temporary Environmental Protection Order (TEPO) in Cantilan, Surigao del Sur; the resumption of ore hauling in Manicani island, in Guian, Samar; the illegal expansion activities of Oceana Gold in Nueva Vizcaya; and just recently, the reinstatement of Intex’s Environmental Compliance Certificate (ECC) in Mindoro are all consequential proof of this.  These were successful resistance of communities against mining companies, but have been reversed by misplaced government priorities and ineffective regulations.

Photo_by_PhilRightsThe Philippine Alliance of Human Rights Advocates (PAHRA), after judiciously discerning received  reliable information, calls for the immediate removal of CHR Chairperson Etta Rosales, Commissioners Ma. Victoria Cardona and Norberto dela Cruz for committing a grave abuse of discretion in making a “midnight” and procedurally-flawed appointment of a person with questionable eligibility, Atty. Marc Titus Cebreros, as CHR Executive Director.

The 4th Commission on Human Rights has been earlier assessed by different human rights groups as under par in performance.  Then came the Ombudsman’s historic decision of dismissing former Commissioner  Cecilia Rachel V. Quisumbing due to graft and corruption and abuse of authority. This was followed by the en banc resolution of finding Com. Norberto dela Cruz of human rights violations and pending case in Ombudsman filed against him by a former staff for misconduct.

Name of victim:          Nestorio Sulatan Ampode, 36 years old
Date of incident:         October 2, 2014; 8:00 A.M.
Place of incident:         Purok 9, Prakatahan, Brgy, Pualas, Don Carlos, Bukidnon
Perpetrators:    Security Guards of Levelit Balarote Zambrano headed by Marcial Balarote (non-state actor)   
Motive:                             Violation of right to life and right to land

Account of the incident:

Nestorio Sulatan Ampode, 36, a member of Ambugkol Manobo Tribal Association (AMTA), belonging to a Manobo tribe was working in the rice field when he was strafed with bullets allegedly by a group of security guards of Levelit Balarote- Zambrano. The incident reportedly happened on October 2, 2014 at about 8:00 in the morning in Purok 9, Prakatahan, Barangay Pualas, Don Carlos, Bukidnon.  

Ampode is an active member of AMTA and a tribal council member of Sitio Prakatahan, Brgy. Pualas, Don Carlos, Bukidnon.

The above-mentioned area where the reported incident occurred is part of disputed land between indigenous peoples who are AMTA members and a certain Levelit Balarote Zambrano.

Despite previous incidents of harassment and threats against AMTA members by security guards employed by Balarote Zambrano, Ampode and his fellow members of AMTA continue to assert their right and work through the legal process on their ancestral land claim. He serves as an overseer of AMTA while he works on facilitating and processing its Certificate of Ancestral Domain Title (CADT) claim.
