June 26 Declaration on the Fight against Torture Impunity in the Philippines

The undersigned participants of the Forum-Dialogue, “End Torture in the Philippines” held at the InterContinental Hotel in Makati City, Philippines on June 26, 2014, International Day in Support of Victims of Torture have adopted the following:

Considering,


1.      That torture is one of the most serious violations of human rights; it destroys dignity, body and mind and has far reaching effect on family and community; freedom from torture is enshrined in various international human rights instruments and national laws; and prohibition of torture is absolute and can never be justified in any circumstance or “non-derogable”;

Make the wheel of justice work

Fight Impunity, Demand for Accountability

Today, we, the United Against Torture Coalition (UATC)-Philippines and various anti-torture advocates on the eight consecutive year marks the International Day in Support of Victims of Torture through the “Basta! Run Against Torture 8” (BRAT VIII) as we renew our resonating call to stop torture and to fight impunity.

While the UATC recognizes the significant improvement in the legal protection against torture in the Philippines, we observed that the implementation of the law and policies has not been made so far with due diligence and efficacy as torture remains prevalent and is still being committed with total impunity. Every year, we are expecting new cases to undoubtedly arise.

The Republic Act 9745, otherwise known as the Anti-Torture Law of 2009 was purportedly enacted to give a meaningful implementation for the UN Convention Against Torture which the Philippines is a state party but remains only good in paper. These observations are clearly reflected in our Torture Impunity Report that will be presented this afternoon to the relevant government agencies in a forum sponsored by the European Union.

taomuna_logo_new_smallThe Task Force Detainees of the Philippines is launching a letter barrage campaign for  the 10 point Human Rights Agenda on Mining, endorsed by different human rights, environmental, indigenous peoples and women’s’ groups and which we aim to reach President Benigno Aquino III, the two Houses of Congress and leaders of LGUs.

We would like to invite everyone to join us in this letter sending campaign before the coming State of the Nation Address –SONA of PNoy and the opening of Congress this July 2014. Our objective is for the 10 Human Rights Agenda on Mining to reach PNoy and leaders of our government and register our call to end large scale mining and prioritize the legislation of the Alternative Minerals Management Bill. You may also print out the Appeal Letter for sign-on in your respective areas and submit to TFDP office No. 45 St. Mary Street, Cubao, Quezon City or fax directly to the contact numbers indicated below.

Joint Statement: Call for an international legally binding instrument on human rights, transnational corporations and other business enterprises

This statement has been endorsed by a wide alliance of international networks, organizations and social movements, listed below.[1] It represents the collective expression of a growing mobilization of global civil society calling for further enhancement of international legal standards to address corporate infringements of human rights. It welcomes the recent initiatives by States in the United Nations Human Rights Council, presented by Ecuador in the session of September 2013, to develop an international treaty on legally binding rules for TNCs on human rights issues.

We, the undersigned organisations,

Concerned about the continuing abuses and violations of human rights occurring all over the world which directly or indirectly engage the responsibility of business enterprises;

Concerned also that such abusive conduct often disproportionately impacts women, who comprise the majority of workers in the most vulnerable sectors, peasants, indigenous peoples, persons living in poverty, children among others, and especially concerned by the fact that justice is denied to those who suffer harm,
